Former mayor sentenced for online pharmaceutical drug sales


A Miami-Dade lawyer was sentenced to 40 months in prison for operating a massive illegal online pharmacy.

Robert Smoley, a former mayor of North Bay Village who has represented numerous high-profile clients during his career, admitted he and others distributed in excess of $48 million worth of drugs through his company, United Mail Pharmacy Services.

Federal agents say the 59-year-old attorney set up an elaborate distribution network from a warehouse in Florida, where he and others shipped drugs after taking orders over the Internet and call centers in Costa Rica and the Dominican Republic. Smoley admitted to selling more than seven million pills through more 17 online pharmacy sites – with most of the orders between 2001 and 2008.

‘CHOSE PROFITS’

“The Smoley drug trafficking organization fed the habits of drug seekers while its members chose profits over the health and well-being of those customers,” said DEA special agent Anthony Williams after Smoley’s guilty plea.

The onetime mayor took orders from customers who filled out online orders for medications, but no effort was made to ensure the information they provided was accurate, the plea agreement says.The orders were then reviewed by doctors who were paid between $2 and $5 per order, with some doctors approving up to 500 orders per day.

Smoley admitted to encouraging doctors to review as many orders as possible each day, knowing they did not conduct physical exams – or review medical paperwork – for his customers.

EU promises to amend norms on seizure of drugs in transit

The European Union (EU) has assured India that it will amend its regulations on the seizure of drugs in transit to India’s satisfaction while ruling out any such confiscation in the meanwhile.

Disclosing this, a senior Commerce Ministry official told presspersons here on Thursday that a statement on this is likely to be made by political leaders from both sides during the forthcoming India-EU Summit in Brussels.

The official, however, said India would withdraw its case against the EU at the World Trade Organisation (WTO) against the ‘illegal’ seizures only after the EU amendments become law.

“The EU Trade Commissioner, Mr Karel De Gucht, recently assured the Commerce and Industry Minister, Mr Anand Sharma, during their meeting that the EU will amend its regulation that was used to seize drugs in transit,” the official said.

The EU regulations deal with “Customs action against goods suspected of infringing certain Intellectual Property Rights (IPRs) and the measures to be taken against goods found to have infringed such rights.”

“During the period it takes for them to bring the amendments into force, it is also assured that there will not be any repetition of such seizures,” the official said, adding this was the first time that the EU had given such a categorical assurance.

India and Brazil had lodged a complaint at the WTO against the EU for their (EU) Customs norms that permitted EU member countries such as Netherlands to confiscate consignments of generic drugs in transit from India to certain Latin American and African countries.

The EU officials seized these generic (off-patent) drugs after complaints by European drug companies that claimed to have patents to these drugs in their respective countries and alleged that these medicines were counterfeit / pirated and, therefore, infringed their IPRs.

However, according to India, these seizures violated the provisions of the WTO agreement on Trade Related Aspects of IPRs (TRIPS) as these drugs were off-patent both in India as well as in the countries where they were being shipped.

India had also pointed out that such seizures would adversely affect the availability of life-saving medicines to poor people in several countries at affordable prices.

Russian says he’s no Viagra spam kingpin


MOSCOW — A Russian who authorities say was responsible for as much as 20 percent of the world’s online spam for Viagra and prescription drugs says he’s innocent.

This week, Russian police announced they have opened an investigation of suspected “spam king” Igor Gusev, 31, on charges of illegal business activities.

Police said “spam king” Igor Gusev?s business generated an estimated $120 million in sales over the past 3 1/2 years
They say Gusev is believed to have paid spammers to promote online pharmacies in the United States, Canada and other countries offering counterfeit products.

Gusev, who operated spamit.com, has fled Russian but told the online site gzt.ru, “I am not the biggest spammer because I do not do spam.”

“I hope that the professionalism of the investigation will try to establish the facts,” he said, suggesting that a business rival was behind the investigation.

Police said Gusev’s business generated an estimated $120 million in sales over the past 3½ years.

SpamIt.com stopped operating on Sept. 27, cutting global spam by an estimated 50 billion messages a day, the New York Times reported.

Domains and Law Enforcement Are Focus of Recent White House and FTC Meetings


The intersection of domain names and law enforcement concerns was the focus of two very high level meetings held recently in Washington, DC. The discussions that ensured mark a demarcation line that will change the tenor of all future discussions of the rights and responsibilities of DNS participants.

On September 28th, a group of leading registries and registrars – many based outside the U.S. – spent a full day at Federal Trade Commission headquarters meeting with personnel from the FTC, Department of Justice, and other Federal agencies – as well as with law enforcement officials from Brazil, New Zealand, Switzerland and the UK. The discussions focused on online crime categories and trends and the assistance desired by law enforcement when dealing with the sale of counterfeit goods, distribution of malware, phishing schemes, and online pedophilia. The government officials outlined the differences in national laws and the assistance they hoped to receive from the registry/registrar community; the DNS participants in turn outlined their roles and their own capabilities, limitations, and due process requirements. No firm conclusions were reached other than a commitment to keep the conversation going.

The following day, many of the same domain name system participants were called into a two and a half hour White House meeting where they were again exhorted to assist in the fight against online crimes and potential cyberattacks. Federal sector participants included IP “Czar” Victoria Espinel, top White House cyber-staffers Aneesh Chopra and Andrew McLaughlin, Cybersecurity coordinator Howard Schmidt, NTIA head Larry Strickling, and multiple other participants from the Department of Justice, Drug Enforcement Administration, Department of Homeland Security, and other Federal agencies. These many high level officials are brought together for a White House meeting only when the issue at hand is of urgent and top tier priority.
